Harvard Law Professor Alan Dershowitz Advises Trump To Pick Non-Partisan Justice For Supreme Court

Harvard law professor Alan Dershowitz said Wednesday President Donald Trump should make a non-partisan pick when choosing Justice Anthony Kennedy’s replacement for the Supreme Court.

“I think the American public wants to see a Supreme Court that’s non-partisan, that’s objective. That is not a Republican Supreme Court or a Democrat Supreme Court. A conservative or a liberal Supreme Court,” Dershowitz said on “Lou Dobbs Tonight” Wednesday.

“They want to see a Supreme Court that construes the Constitution fairly and openly. And I think for the last 40 years we’ve seen politicization of the court,” he continued. “Now we see 5-4 decisions on partisan grounds. That’s not good for American justice.”

“The big key issue will be whether the president nominates a free-wheeling conservative who thinks it’s open to him or her to overrule wrong decisions, or whether it’s a more moderate conservative who will say ‘look I would have voted differently, but the law is the law and I’m not going to change it,'” he concluded.
