Fox News legal analyst Judge Andrew Napolitano scolded California for targeting the free speech of pro-life groups and said the government can’t force anyone to express a political opinion.
Napolitano was referring to a California law forcing pro-life clinics to promote abortion as an alternative. NIFLA v. Becerra is now headed for the Supreme Court.
“This is so basic, guys. You would think this was resolved 227 years ago when the First Amendment was adopted,” Napolitano said on “Fox & Friends” Tuesday. “The First Amendment which says Congress shall make no law bridging the freedom of speech, after the Civil War applies to the state. The flip side of that is Congress and the states can’t force speech.”
“The government can’t force you to express a political opinion with which you disagree,” he added.
Napolitano thinks the law is so frivolous it should have never made it this far in the courts.
“It shouldn’t be before the Supreme Court. It shouldn’t have happened,” he said. “Legislatures who are our representatives shouldn’t force people to say things they don’t believe. And that’s the lesson of the First Amendment.”
“This is part of the progressive anti-life mentality of the government in California,” Napolitano concluded. “It’s other governments as well. But California’s the worst.”
