A previously deported illegal migrant charged with forcibly raping a child was allowed back into the U.S. by Biden administration officials, according to the Department of Homeland Security (DHS).

DHS officials have lodged an immigration detainer for Lorenzo Lopez Alcario, a Guatemalan illegal migrant accused of forcibly raping a child in the Boston metropolitan area, the department confirmed in a Wednesday press release. Alcario had already been deported from the country during President Donald Trump’s first term in office, but was able to unlawfully return several years later under President Joe Biden’s watch.

“Lorenzo Lopez Alcario is a pedophile illegal alien from Guatemala who should’ve never been in the U.S. in the first place,” DHS Assistant Secretary Tricia McLaughlin said in a prepared statement. “He is being charged with committing a heinous crime — the rape of a child.”

“Despite his previous criminal charges and deportation, President Biden released this barbaric criminal into American communities in 2022,” McLaughlin continued. “Under President Trump and Secretary Noem, ICE lodged a detainer to ensure this criminal illegal alien will not be allowed to terrorize American citizens and will deport this child predator to prevent further victims.”

Alcario originally entered the U.S. at an unknown date and time, according to DHS. He was arrested by police in Arlington, Virginia, on drug charges in July 2017 and transferred into Immigration and Customs Enforcement (ICE) later that month.

Following a removal order from an immigration judge, Alcario was deported from the U.S. in September 2017, DHS stated. However, he illegally re-entered the country again on June 17, 2022 and — despite his criminal history and previous illegal entry — was released into the U.S.

The Guatemalan national has since been accused of heinous crimes in Massachusetts.

Police in Marlborough, Massachusetts, arrested Alcario Saturday on charges of aggravated rape of a child, exhibiting a child in a sexual manner, resisting arrest, and assault and battery, according to the Boston Herald. Prosecutors say his victim was “tied, bound or gagged” during the attack, which allegedly occurred in April.

The mother of the victim claims she discovered a video of the Guatemalan man and her daughter, according to MetroWest Daily News. Middlesex County prosecutor Katharine Folger stated in court that the video showed Alcario raping the girl.

It’s not immediately clear how cooperative local law enforcement officials — which must operate under Massachusetts sanctuary polices — will be with their federal immigration partners. A spokesperson for the Marlborough Police referred a request for comment from the Daily Caller News Foundation to the local district attorney’s office, which did not respond to a request for comment.
