“Shark Tank” star Kevin O’Leary sparred with left-wing political consultant Tezlyn Figaro Monday over pre-trial detention in prisons and jails.
The average homicide rate dropped by 21% in nearly three dozen major U.S. cities in 2025, the largest one-year drop of all time, according to statistics compiled by the Council on Criminal Justice (CCJ). Figaro claimed on “CNN News Night” that some people have gone to prison without breaking the law.
“Everybody doesn’t always break the law and go to prison. See, that’s where you’ve been so focused on the Dow, and haven’t been focused on what’s actually happening —” Figaro claimed before O’Leary responded, “No, no. I’m focused on breaking the law. You shouldn’t break the law if you want to stay out of prison.”

“No, no. And I’m focused on something called due process and focused on people who get incarcerated before they’re actually found guilty. Something called — where people can’t afford bail,” Figaro shot back, with O’Leary responding, “So, you approve that if somebody murders and they shouldn’t go to prison?”
Some states and the District of Columbia sought to institute a program called “cashless bail,” seeking to address alleged racial and economic disparities in pre-trial incarceration. O’Leary and Figaro continued to spar in a back-and forth until host Abby Phillip intervened.
“All right. Kevin, hang on a second. Kevin, hang on a second,” Phillip said, before adding, “All right, we’re just talking about — we’re talking about a lot of different things here, okay? She’s making a legitimate point that some people stay in prison even when they’re not having a trial and that’s a controversial issue.”
“You don’t want to go to prison? Don’t break the law,” O’Leary replied, with Phillip responding, “Okay. It’s called innocent until proven guilty. That is the principle —”
O’Leary then cut Phillip off, reminding her that in the United States, people accused of a crime go to trial.
