CNN’s chief legal analyst Jeffrey Toobin called Republican Sen. Jeff Flake of Arizona “pathetic” on “New Day” Friday and said he stands for nothing.
“Jeff Flake, having called for the hearing, didn’t even bother to use his five minutes,” Toobin said. “For one minute, he sort of said, ‘Oh this is very sad.'”
“If there is a weaker, more pathetic political figure in the United States than Jeff Flake, I’m not aware of who it is,” he continued. “And I thought yesterday was a classic demonstration of his inability to stand for anything.”
Shortly after Toobin’s comments, it was announced Flake would be voting yes on Kavanaugh’s confirmation, according to a statement.
“I will vote to confirm Judge Kavanaugh,” Flake said. “I left the hearing yesterday with as much doubt as certainty. What I do know is that our system of justice affords a presumption of innocence to the accused, absent corroborating evidence.”
Toobin also took issue with Republicans complaining about a delay in Kavanaugh’s confirmation process and accused them of being hypocritical, citing former Obama Supreme Court nominee Merrick Garland.
“By the way, let’s just not forget about the delay business. Can you delay it for a week? Can you delay it for two days? Merrick Garland. They delayed filling a seat for a year,” he concluded. “The idea that they can’t delay this hearing or this vote for a week is preposterous.”
